Dhaka: A leave to appeal has been filed today seeking a stay on the lower court judgment and Election Commission (EC) gazette declaring BNP leader Ishraque Hossain the mayor of the Dhaka South City Corporation (DSCC).
According to Bangladesh Sangbad Sangstha, the appeal was filed with the concerned wing of the Appellate Division by lawyer and DSCC resident Md Mamunur Rashid. This appeal follows the High Court's rejection of a writ petition filed by advocate Mamun, which challenged the lower court's decision to appoint Ishraque as the mayor of the DSCC.
The High Court had summarily rejected the writ petition that contested the Dhaka First Joint District Judge and Election Tribunal's verdict on the DSCC mayorship. 'Rejected summarily as the petitioner with observation and direction,' stated the order passed by the High Court division bench of Justice Md Akram Hossain Chowdhury and Justice Debasish Roy Chowdhury.
Confirming the matter, petitioner's lawyer Advocate Mohammad Hossain explained that the appeal was filed, pleading to stay the court judgment and EC gazette. The matter is scheduled to be heard by the Appellate Division Chamber Judge court.
Earlier, Judge Md Nurul Islam of the Dhaka First Joint District Judge and Election Tribunal had canceled the results of the 2020 DSCC election and declared BNP Leader Ishraque Hossain as the DSCC mayor on March 27. Subsequently, the Election Commission issued a gazette notification on April 27, declaring the BNP leader as mayor.
