SC allows ACC appeal to dismiss officials without show cause notice

The Appellate Division of the Supreme Court (SC) today allowed an appeal of the Anti-Corruption Commission (ACC) against a High Court (HC) decision to scrap one of its (ACC) rules that allows the commission to dismiss officials without serving any show cause notices.

The Appellate Division bench headed by Chief Justice Hasan Foez Siddique pronounced the judgment after holding hearing on a civil appeal filed in this regard.

According to Section 54 (2) of Anti-Corruption Commission (Servants) Service Rules-2008, the commission can terminate any officer either issuing 90 days' notice or paying 90 days' salary in cash.

"After today's judgment, the High Court judgment, scraping the said rule, became invalid. So, the ACC can take action as per the rule. We can tell about this in detail after getting the full text of the apex court judgment," ACC counsel senior advocate Khurshid Alam Khan told BSS.

The High Court on October 27, 2011, had scrapped the rule after holding hearing on a writ filed by sacked ACC official Md Ahsan Ali.

The ACC later filed a leave to appeal petition against the High Court order, which was dismissed by the apex court in 2016. The anti-graft body in 2017, filed a review petition against that, and the Appellate Division on November 28, 2021, allowed ACC to appeal against the High Court judgment. The ACC filed the appeal petition and the Appellate Division today came up with its judgment on the matter.
