New Legal Framework Introduces Lifetime Property Enjoyment Rights

Amman:The Transfer of Property (Amendment) Act, 2026 has been enacted to reform the legal landscape for property transfers. This amendment permits donors to gift property while retaining the right to use and enjoy it throughout their lifetime, providing an alternative mechanism under the existing law.

According to Bangladesh Sangbad Sangstha, Law, Justice and Parliamentary Affairs Minister Md Asaduzzaman emphasized that the new law aims to facilitate property transfers without obstructing traditional methods such as heba or other lawful means. The law preserves the principles of Islamic law, ensuring that no interference occurs, and aims to counter any politicization of the issue.

Supreme Court lawyers have hailed the amendment as timely and significant. Advocate Ekhlas Uddin Bhuiyan noted that the law grants donors the ability to gift property to family members while maintaining usage rights, addressing concerns about the treatment of parents after property transfers.

Supreme Court lawyer Siddik Ullah Miah highlighted that the act will safeguard donors‚¬Å¡¬€¦¡¬€š¬¦¡¬€š¬…¡¬¦¡¬‚¬Å¡¬€¦¡¬€š¬¦¡¬€š¬…¡¬¦¾¢ dignity, allowing them to transfer property ownership while retaining full usage rights. This development is expected to enhance family relationships and discourage neglectful behavior towards elders.

The Amendment Act, considered a balanced legal solution, seeks to protect the economic and social security of the elderly while ensuring family stability. It was made public on September 8 following parliamentary approval and presidential assent.
