Appellate Division Stays High Court Verdict on Supreme Court Secretariat

Dhaka: The Appellate Division of the Supreme Court (SC) today stayed the High Court judgment that had ordered the establishment of a separate secretariat for the Supreme Court (SC) within three months.

According to Bangladesh Sangbad Sangstha, a four-member apex court bench, led by Chief Justice Zubayer Rahman Chowdhury, passed the order after hearing a state petition that pleaded for the verdict to be stayed. The Appellate Division has also scheduled June 16 for the hearing on the appeal filed in this connection.

Attorney General Barrister Md Ruhul Quddus Kazal represented the state in court, while Advocate Mohammad Shishir Manir argued on behalf of the writ petitioners. Senior advocate Ahsanul Karim and advocate Karishma Jahan also appeared for separate appellants.

The High Court (HC) had delivered its judgment on September 2, 2025, directing the government to establish a separate secretariat for the judiciary within three months. The verdict was pronounced by a High Court division bench comprising Justice Ahmed Sohel and Justice Debasish Roy Chowdhury, who declared a previously issued rule absolute and struck down an amendment to Article 116 of the Constitution, thereby restoring its original 1972 provision.

The full 185-page text of the High Court judgment was made available on the Supreme Court’s website on April 7, 2026. Subsequently, the state filed an appeal against the verdict on May 21, 2026.
