Dhaka: Dr Asif Nazrul, Adviser on Law, Justice, and Parliamentary Affairs, stated today that granting bail to followers of fugitive leader Sheikh Hasina would be inconsistent with established rules. This statement comes in the wake of Hasina's repeated threats against those involved in the July Mass Uprising.
According to Bangladesh Sangbad Sangstha, Dr Nazrul expressed his concerns while speaking to reporters after meeting Chief Justice Syed Refaat Ahmed at the Supreme Court. He emphasized that judges should be cautious about granting bail to individuals who pose potential threats. "Granting bail to her party's followers would not be consistent with any rules of bail. Judges should consider that if someone who could potentially kill me is granted bail, the responsibility for that act could fall on them," he remarked.
Dr Nazrul further explained that he intends to discuss this issue with the incoming Chief Justice. He emphasized the necessity of granting bail as a legal right but cautioned against doing so when there is credible concern about potential harm. He also acknowledged the outgoing Chief Justice's role in implementing judicial reforms aligned with the July Mass Uprising's goals.
The law adviser thanked Chief Justice Ahmed for his service during a critical period for the nation, noting his support for laws enacted by the Law Ministry. Nazrul also voiced concerns about certain High Court benches granting an unusual number of bails, a matter he had previously discussed with the Chief Justice.
While acknowledging that the impact of such bail practices has lessened, Dr Nazrul noted ongoing anxiety about the potential release of dangerous individuals. He reiterated that while the Law Ministry does not control the High Court, he has previously communicated his apprehensions to the Chief Justice, who has taken appropriate measures in response.
