Why Babul Akter should not be granted bail: HC

The High Court on Monday issued a rule asking the government to explain why former Chattogram Superintendent of Police (SP) Babul Akter, arrested in a case over the murder of his wife Mahmuda Khanam Mitu in 2016, will not be granted bail.

A divisional bench of Justice AKM Asaduzzaman and Kazi Ejarul Haque Akondo issued the rule after hearing the bail petition of Babul Akter.

The respondents were asked to respond to the rule in the next two weeks.

Senior lawyer Mansurul Haque Chowdhury and lawyer Mohammad Shishir Monir appeared for his bail while Deputy Attorney General Md Aminul Islam and Assistant Attorney General Md Jahangir Alam and Md Humayun Kabir represented the state.

Earlier on January 6, a Chattogram Court denied bail to Babul Akter in the case. He was shown arrested on January 9.

On June 5, 2016, unidentified assailants gunned down Babul’s wife Mitu at the port city’s GEC intersection while she was going to drop her son Mahir Akhter, 7, for a bus of Chittagong Cantonment Public School and College.

Soon after the crime, Babul filed a murder case at Panchlaish Police Station against three unidentified men.

The case was transferred to the Police Bureau Investigation (PBI) in 2019 after Mitu’s father, himself a retired police officer, filed a complaint against the CMP’s mishandling of the case.

On May 12, 2021, the PBI submitted its final report and arrested Babul Akter in another case filed by Mitu’s father and since then he has been in prison.

Babul Akhter also filed a ‘naraji petition’ against the PBI report on October 14.

On November 3 last year, a Chattogram Court rejected the final report of Police Bureau of Investigation (PBI) the murder case and ordered it to conduct further investigation.

Cabinet approves amendment to legalize digital evidences

The Cabinet on Monday approved the draft of ‘Evidence (Amendment) Act, 2022’ incorporating the admissibility of digital evidences by the court.

The approval came at the Cabinet’s meeting chaired by Prime Minister Sheikh Hasina who joined it virtually from her official residence Ganobhaban.

Other cabinet members were connected from the cabinet room of the Cabinet Division in Bangladesh Secretariat.

“The digital evidences will be accepted from now as per the proposed law,” said Cabinet Secretary Khandker Anwarul Islam while briefing reporters after the meeting.

He said evidence, documents and such other things were coming online after the inception of digital or online trials of cases amid the Covid-19 pandemic. There is nothing directly about online or digital evidence in the existing Evidence Act, he said.

With the existing law, many legal complicacies might appear if any aggrieved person files a petition with the higher court, challenging the verdict of the lower court in case of acceptance of digital evidence or documents, he said.

In the draft law, a provision was kept for making forensic examination of digital evidence. “If the court thinks necessary or any party of the case doubts about the authenticity of such evidence, these can be gone through forensic examination,” said the Cabinet secretary.

He said sufficient laboratories are there in the country for forensic examination of digital evidence and BCC has also very high technology in this regard. The government might spread the laboratories and technology to convenient places of the country for the sake of submission of digital evidence, he said.

The submission of false or manipulated evidence would be punished as per the laws concerned.

“If anyone twists (tampers) evidence, the persons will be dealt with as per the section 211 of the Penal Code or the section 57 of the Digital Act,” said the Cabinet Secretary.

Besides, the Cabinet in principle approved the draft of ‘Bangladesh Supreme Court Judges (Leave, Pension and Privileges) Act, 2022’ with a provision of a monthly special allowance of Tk 70,000 for a retired judge.

The special allowance will be given to meet expenses against different purposes like his domestic help, car diver, house guard and maintenance of office cum residence, said Anwarul.

“The draft law was brought to formulate a law repealing an ordinance of the military regime as per a judgment of the high court,” he said.

The proposed law will replace the Supreme Court Judges (Leave, Pension and Privileges) Ordinance, 1982.

Besides, the Cabinet rejected another proposal to incorporate a provision in the draft law that the State would provide security to a retired chief justice till a certain period.

It was argued that there is no such provision in other countries. “If the government thinks, it can provide such security to a retired chief justice with an executive order. So, the proposal was not agreed,” he said.

The Cabinet gave the final approval to the draft of Abandoned Houses (Supplementary Provisions) Act, 2022 keeping a provision that the confiscated properties of a convicted war criminal would be treated as abandoned assets.

The existing law is also an ordinance of 1985. Since it was promulgated during the military regime, the new law had to be brought as per the judgment of the High Court. “Few small changes were made here,” said the Cabinet secretary.

“If anyone is convicted in a war criminal case and the court seizes his or her property, these will be considered as abandoned property under the proposed law,” he said.

Besides, the final authority was given to the head of the government instead of the government in case of disposal of anything regarding high-valued buildings like those in Gulshan, Banani and Dhanmondi, he said.

The draft law was placed to replace the Abandoned Buildings (Supplementary Provisions) Ordinance, 1985.

The meeting also gave the final approval to the draft of ‘Zakat Fund Management Act, 2022’ to repeal an ordinance of the military regime.

“As per the draft law, there would be a Zakat fund board under the supervision of Islamic Foundation to collect and distribute Zakat,” said the Cabinet secretary.

UAE authorities order arrests over rare riot at soccer match

A soccer game in the United Arab Emirates erupted into violent scuffles between angry fans of opposing teams, a rare scene of chaos that led authorities to call for the arrest of “all rioters.”

Public prosecutors in the capital of Abu Dhabi issued an order Sunday to arrest those who instigated the riot at the match between the Al Ain and Al Wahda clubs, warning authorities “will respond firmly” and urging “sportsmanship among club fans to avoid endangering the lives and safety of others.”

The statement on the UAE’s state-run news agency WAM did not offer details on the number of arrested.

Footage posted on social media showed Emirati fans streaming onto the field in their traditional white kanduras and start attacking players as security guards rushed to restrain them.

Other video showed groups of men beating and flinging shoes at each other in the stadium stands. At least one spectator appeared to be injured lying on the ground as rival fans brawled. It wasn’t clear how many people were injured in the riot.

The incident marked a rare outburst of violence in this business-friendly, tourism-focused Gulf Arab sheikdom. Protests, demonstrations and political expression are heavily suppressed in the autocratic country.

Al Ain defeated close challenger Al Wahda in the match 1-0, extending their lead at the top of the league this season to seven points.

Hadisur’s body reaches Dhaka

The body of Md Hadisur Rahman, who was killed on March 3 in a rocket attack on a Bangladeshi vessel stranded at a Ukraine port, reached Dhaka on Monday.

A Turkish Airlines flight carrying the body landed at Hazrat Shahjalal International Airport around 12.30 pm, said an intelligence agency official at the airport.

The body of Hadisur was scheduled to reach Dhaka on Sunday from Romania via Istanbul but the flight carrying the body failed to take off timely due to heavy snow storm in Istanbul.

Earlier on March 9, 28 surviving crew members of the Bangladeshi ship who were stranded in war-torn Ukraine, arrived in Dhaka.

They went from Ukraine to Moldova to reach Bucharest, from where they flew to Dhaka.

The Bangladesh Shipping Corporation (BSC) ship had been stranded at Olvia port in Ukraine since February 23, following Russia’s invasion of its eastern European neighbour.

Hadisur, third engineer of the BSC ship, was killed in a rocket attack on the vessel. The ship had since then been declared abandoned.

Hadisur’s body was preserved in a bunker near Ukraine as the procedure to bring back the body was being delayed due to the worsening situation in Ukraine.

Dhaka Premier League cricket begins Tuesday

The Dhaka Premier Division Cricket League, a 50-over domestic cricket event, is all set to begin on Tuesday

In this year’s league, a total of 11 Dhaka-based clubs are participating. Prime Doleshwar, a regular participant of the league, is not going to play this year. Nizamuddin Chowdhury, the CEO of Bangladesh Cricket Board (BCB), has said that the club did not mention any specific reason behind their decision to pull out from the league.

The first few rounds of the Dhaka League will miss the services of the national team players who are busy touring South Africa.

“We have a strong team, and our main goal is to qualify to the Super League phase,” Mohammad Ashraful, the captain of Brothers Union told the reporters on Monday. “We haven’t qualified to the Super League for a long time.”

Mohammedan Sporting Club captain Shuvagata Hom said they also have a good team that can win the title. “We will miss the national team players in the first few rounds which is very unfortunate. Still, we have a good set up and we are up to play well,” he said.

Akbar Ali, the U-19 World Cup-winning captain of Bangladesh, will lead Gazi Group Cricketers in this year’s Dhaka League.

“It’s a long event. So we are looking forward to making a good start. For now, the fixture of the first two rounds has been finalized. We would like to do well in these two matches first,” Akbar said.

Walton, the largest electronics goods manufacturer in Bangladesh, is the sponsor of the Dhaka League. This is the 10th time they are patronizing the Dhaka League cricket.

Pakistan collapses to 100-7 in 2nd test against Australia

Pakistan collapsed to 100-7 at tea against Mitchell Starc’s searing pace in reply to Australia’s mammoth 556-9 declared on the third day of the second test on Monday.

Starc picked up 3-24 in a superb spell of left-arm fast bowling which included the wickets of Azhar Ali and Fawad Alam off successive deliveries.

Pakistan lost six wickets in the middle session for only 62 runs and still needs 257 runs to avoid the follow-on.

Home captain Babar Azam was unbeaten on 29 with Hasan Ali yet to score. Babar survived a close lbw referral against Pat Cummins before he had scored.

Australia made early inroads when leg-spinner Mitchell Swepson ran out Abdullah Shafique before lunch.

Nathan Lyon then ignited the collapse immediately after lunch when Imam-ul-Haq played a terrible shot and holed out to mid-on before Starc ran through the middle order.

Azhar played away from his body and Cameron Green took an edge in the slips while Alam was out plumb lbw following a vicious yorker. Rizwan Ali was beaten off the hat-trick ball before eventually succumbing to Cummins.

Despite losing Starc (28) to the second ball, which gave Shaheen Afridi his first wicket, Cummins and Swepson (15 not out) scored freely against spinners Sajid Khan and Nauman Ali.

Bangladesh women make history beating Pakistan in World Cup

Bangladesh Women national team beat their Pakistan counterpart in the ongoing ICC Women’s World Cup by nine runs on Monday at Hamilton.

It was Bangladesh women team’s maiden win in the World Cup. The Bangladesh Men team also beat Pakistan to earn their maiden World Cup win back in 1999.

Fargana Hoque and the captain Nigar Sultana hit 71 and 46 while batting first and helped Bangladesh post a challenging total of 234 for seven in 50 overs. It was the second fifty by Fargana in this World Cup. Sharmin Akhter did well with the bat scoring 44.

For Pakistan, Nashra Sandhu bagged three wickets conceding 41 runs in 10 overs.

In reply, Pakistan fell short of nine runs despite a ton from Sidra Ameen. Pakistan had a 91-run opening stand, which has a good foundation for them to chase down a challenging total.

Rumana Ahmed broke Pakistan’s opening stand, and after that Pakistan lost the momentum they had.

Fahima Khatun scalped three wickets conceding 38 runs in eight overs while Rumana bagged two wickets.

Pakistan eventually ended up on 225 for nine in 50 overs and lost the match.

In their earlier matches, Bangladesh lost to South Africa and New Zealand. Coming to the third match of their first World Cup, Bangladesh managed to record their maiden win.

AHF Cup Hockey: Holders Bangladesh crush Singapore 7-0

Three-time defending champions Bangladesh earned their 2nd consecutive victory in Pool B of the Men’s Asian Hockey Federation (AHF) Cup 2022 crushing Singapore by 7-0 goals at the GBK Field in the Indonesian capital Jakarta on Monday.

In the day’s match, Shahanur Rahman Sobuj scored three field goals in the 14th, 27th and 59th minutes

and was adjudged best player of the match.

Besides, Ashraful Islam, Arshad Hossain, Khorshedur Rahman and Pushkar Kisha Mimo scored one goal each for Bangladesh.

Bangladesh, which made a flying start in the nine- team AHF Cup Hockey 2022 outplaying hosts Indonesia by 7-2 goals last Friday, will play Iran on Tuesday (March 15 ) and upper ranked Oman on March 17 in the remaining Pool B matches.

The tournament is also a qualifying competition for the next Men’s Asia Cup Hockey.

Amputee Football: Japan emerge champions, Indonesia runners-up to qualify for World Cup

Japan qualified for the Amputee Football World Cup 2022 in Turkey from East Asia with an all-win record beating Indonesia by 2-0 goals in their last match at Bir Shereshta Shaheed Shipahi Mostafa Kamal Stadium in Kamalapur on Monday.

Despite the day’s maiden defeat, Indonesia also qualified for the Amputee World Cup 2022 as the runners-up team from East Asia Qualifier.

Can’t express my feelings in words: Nigar Sultana after historic win against Pakistan

“I can’t express my feelings in words,” said an exalted Nigar Sultana after leading Bangladesh women team in their historic first-ever World Cup victory against Pakistan on Monday.

The nine-run win in New Zealand’s Hamilton, also the maiden against Pakistan, almost eclipsed Bangladesh women’s loss in their first two matches to South Africa and New Zealand in this World Cup.

“We beat Pakistan. We beat them in the World Cup. It’s a history,” captain Nigar said. “I can’t express my feelings in words. It’s a big achievement, and we would like to carry this momentum forward.”

What Bangladesh men’s team did in 1999— beating Pakistan in World Cup and securing first World Cup win— women did in 2022.

“We know this Pakistan team better than the other teams as we played them in many matches,” Nigar added. “Playing them on a regular basis helped us to beat them in the World Cup.”

Bangladesh batted first in this match and posted a challenging total of 234 for seven in 50 overs. Fargana Hoque scored 71 for Bangladesh while Nigar scored 46.

Police conduct drive in Nalbhog to catch their assailants; 9 arrested

Detective Branch (DB) of Dhaka Metropolitan Police (DMP) arrested nine people and recovered a police handcuff in connection with an assault on members of Dakshin Khan Police Station in the capital on Sunday.

The arrested people were identified as Lashkar Ali, Md. Nurul Islam, Md. Jahangir Alam, Zahirul Islam, Md. Kamrul Islam, Md. Nazrul Islam, Jhinuk, Khushi and Champa.

Mirpur zonal team of DB (Mirpur Division) conducted simultaneous drives in Nalbhog area under Turag police station in Uttara on Sunday and arrested them.

Earlier, a team of Dakkhin Khan police station arrested two people named Mohammad Kamrul Islam and Zahirul Islam along with some cannabis while conducting checking activities in the area adjacent to Kotbari Railgate check post. Later, 30-40 unidentified people attacked the police team by randomly throwing brickbats and snatching items of the police, including the police handcuffs.

Five police members, including an ASI, were injured during the attack on the police team. A case was filed with Dakkhin Khan police station accusing 16 named individuals and several others unnamed.

The arrested people were members of an organized drug trafficking syndicate . They have been running drug business in the area for a long time, said Additional SP Md Syful Islam.
