HC declares VAT on English medium school’s tuition fee illegal

The High Court today declared 7.5 percent value added tax (VAT) on tuition fee of English medium schools, illegal.

A High Court division bench comprising Justice Zubayer Rahman Chowdhury and Justice Md Mozibur Rahman Miah passed the order while disposing of a rule issued earlier in this regard.

Earlier on August 9, 2015, the High Court issued the ruling upon the authorities concerned, asking them to explain in three weeks as to why their decision to impose 7.5 percent VAT on the tuition fee of the private university students, shall not be declared illegal.

A High Court division bench comprising Justice Sheikh Hassan Arif and Justice JN Deb Choudhury passed the order, acting on a petition filed by some teachers and students of Daffodil International University.

Earlier on July 4, 2015, National Board of Revenue (NBR) issued a notification imposing 7.5 percent VAT on tuition fee of the students of the private universities, private medical and engineering universities.

Finance secretary, NBR secretary and the chairman of University Grants Commission had been made respondents in the ruling.
