According to the High Court’s complete written order on Evaly’s interim board of directors, customers cannot pressurize the board for six months to pay their debts.
The HC bench of Justice Muhammad Khurshid Alam Sarkar on Thursday revealed the 10-page written order on forming a five-member board to manage, control and assess the liabilities of e-commerce platform Evaly.
However the consumers may inform the board and the court about their debts, said the order.
The order also determined the amounts of honorarium for the board members.
According to it, former justice Shamsuddin Chowdhury Manik, chairman of the board, will get Tk 25,000 for attending each board meeting and Tk 2 lakh for each annual general meeting.
Besides, three members of the committee former secretary Mohammad Rezaul Ahsan, chartered accountant Fakhruddin Ahmed and lawyer Barrister Khan Mohammad Shamim Aziz will get Tk 10,000 each for board meetings and Tk 1 lakh each for annual board meetings.
Another member of the committee, additional secretary Md Mahbub Kabir on special duty will get his salary from the government for now. After retirement he will get a salary from Evaly equal to his last salary from the government.
On October 18, the High Court formed the five-member committee to run e-commerce institution Evaly.
Followed by the written order the board will immediately hold their first meeting, assess the liabilities, commission an audit and handle other matters.
After that, if the board finds Evaly incapable of operating, they will proceed for its termination or otherwise the board will continue to run it, said petitioner’s lawyer barrister AM Masum.
As both the Chief Executive Officer and Chairmen of the company are currently in jail, the board will do everything regarding the running of the company, he said.
On November 23, the board will submit a progress report to the court, said barrister AM Masum.
Evaly CEO Mohammad Rassel and his wife Shamima Nasrin, the chairman of the platform were arrested on September 16, after a customer named Arif Baker filed a case at Gulshan Police Station alleging that e-commerce platform was not delivering product despite taking advanced payments.
Meanwhile customer Farhad Hossain submitted an application at the High Court seeking dissolution of the beleaguered company and direction on forming a board of directors for the company.
On September 22, the High Court ordered a ban on the sale and transfer of movable and immovable property during a hearing on the application and issued a notice questioning why Evaly will not be disbanded.
On September 30, during a hearing in this regard the HC directed RJSC to submit all the documents of Evaly within October 11, which they did.
Followed by which the High Court ordered to form the board committee.
